The EEOC has increasing targeted employer background screening practices (e.g., criminal background, credit history, qualification standards) as having a “disparate impact” based on race, national origin, gender, and even disability. As a result, employers have shied away from these important risk management tools, which exposes them to potentially more serious risk. This program will examine the EEOC’s war on background screening, discuss ways that employers can continue lawfully to screen applicants/employees, and offer suggestions about how employers can prepare to defend screening practices.
